After a fall in Pasadena, the practical problem is often identifying who controlled the place where you were hurt and what evidence still exists. A storefront, sidewalk, parking area or bus stop can involve different owners and maintenance arrangements. Providence Trial Lawyers can review the circumstances, the injury and the available legal options. We serve Pasadena from our Los Angeles office, not a Pasadena branch.

A request to repair a hazard, a request for maintenance records and a claim for compensation do different jobs. The Pasadena route organizer below helps you keep those tasks separate while preserving the facts needed to evaluate an injury claim. You do not need to resolve every ownership question before asking for legal advice.

Start with control, the condition and the injury

A fall does not automatically make a property owner or a city liable. The investigation needs to identify the condition, who was responsible for the relevant area, what reasonable care required and how the condition caused the injury. Civil Code section 1714 states California’s general responsibility for injuries caused by a lack of ordinary care in managing property or one’s person. The specific facts and applicable rules still matter. [1]

Be precise about where your foot was and what happened. “Outside the store” may refer to an entrance mat, a private walkway, a parking lot or a public sidewalk. Those are leads for investigation, not interchangeable descriptions. Keep the closest street address, the business name, photographs showing the wider location and the exact spot of the fall.

For a spill, useful questions may include how it got there, what inspections occurred and whether there were warnings. For an uneven surface, the questions may involve its dimensions, visibility, condition over time and earlier complaints. Do not guess about how long a hazard existed. Identify what you personally saw and what another person told you.

Preserve a clear record without recreating the accident

Get medical attention appropriate to your condition. Call 911 for an emergency. Do not return to an unsafe area, move an obstruction into a new position or attempt to repeat the fall for a photograph. If it is safe to document the scene, preserve both a close view of the condition and a wider view showing how people approached it.

  • Keep original photos and video, including timestamps and the files that show the surroundings.
  • Preserve the shoes and other relevant items without changing them unnecessarily.
  • Write down lighting, weather and any warning signs as you actually remember them.
  • Record the names and contact information of witnesses and the person who received an incident report.
  • Keep receipts or other records that help place you at the location.
  • Identify possible camera holders promptly, without assuming video exists or will be retained.

If a business takes an incident report, ask how you can identify that report later and keep any copy or acknowledgment provided. Read anything you are asked to sign and distinguish reporting an incident from signing a release. Our fall evidence preservation checklist explains the wider evidence file.

Three Pasadena routes that should not be confused

Route one: report a condition that needs attention

Pasadena Public Works says a temporary sidewalk patch can be requested through the City Service Center at 626-744-7311 or by reporting the issue online. Its street-maintenance page also discusses potholes, lighting and other maintenance issues. Use the category that matches the condition you observed. A repair request asks that a condition be addressed; it is not itself a request for injury compensation. [2]

The same page says property owners are responsible for permanent sidewalk repairs along their frontage under Pasadena Municipal Code section 12.04, including damage caused by street trees. That maintenance statement does not, by itself, decide who is legally liable to an injured pedestrian. Do not turn a frontage rule into an automatic claim against the adjacent owner. The actual ownership, control, condition and applicable law need review. [2]

Route two: identify the records that may explain the condition

An investigation may need earlier repair requests, inspection information, work orders, permits or records identifying who maintained the specific area. Begin with the exact location and condition, not a broad request for everything about a street. Ask the appropriate record holder about its process and keep the response, including any referral to another department or entity.

These are possible evidence categories, not a promise that the City or a private business has each record or must disclose everything requested. A missing result is not proof that no complaint or inspection occurred. A repair reference number can be useful for locating records, but it is not a legal claim number unless the receiving entity says it is.

Route three: a claim alleging the City owes compensation

Pasadena’s Liability Claims and Insurance Division says to ensure you are filing with the appropriate entity before beginning. Its current owner page offers an online claim route or a form submitted to the City Clerk’s Office in person or by U.S. mail. It directs users to read the Claims Information Sheet in full and submit the form as that sheet specifies. [3]

Those instructions concern a claim against the City. They do not establish that the City owns the location or is responsible for your injury. They also do not replace the procedures that may apply to another public entity or a private party. Use the current City claims page rather than an old downloaded form or a remembered web address.

The linked PDF’s information sheet still prints an older City-Attorney web route, while the current filing-owner page is under City Manager. Follow the current owner page to find the filing options and review the current linked instructions; do not assume every historical printed web path is current. No claim has been submitted or portal operation tested for this page. [4]

A location-and-task log for a Pasadena fall

Keep one location description, but separate the follow-up tasks. This prevents a maintenance acknowledgment from being mistaken for evidence that a compensation claim was received.

  1. Pin down the place. Record the closest address, direction of travel, entrance or landmark, exact surface and the photograph showing the location.
  2. List possible controllers. Record the business, property manager, adjacent owner or apparent public agency as leads to check, not conclusions.
  3. Preserve the condition. Identify the original photos, witness details, possible recordings and the person who received any incident report.
  4. Track maintenance separately. Note the condition reported, receiving department, submission date and service reference. Do not label it a damages claim.
  5. Track records separately. Note the records sought, record holder, request date, response and outstanding items.
  6. Track claim advice separately. Note which entity and deadline questions need legal review. If a claim is presented, preserve the exact submission and proof of receipt through the proper route.

This is a private organizer, not a form to submit to Providence or the City. Do not post medical details, identification documents or your completed log in public comments. Bring the file to your consultation and explain any uncertainty rather than filling a blank with a guess.

Public-property claims require more than a maintenance complaint

When a dangerous condition of public property is alleged, Government Code section 835 requires specified proof. It addresses a dangerous condition, causation, a reasonably foreseeable risk of the kind of injury, and either creation through an employee’s negligent or wrongful conduct within the scope of employment or sufficient prior actual or constructive notice. Other statutes can limit liability. A photograph of a defect does not, on its own, establish all those requirements. [5]

Earlier complaints or repair records may be relevant to notice, but their meaning depends on what they actually describe and when. The fact that an agency accepted a service request after your fall does not establish it knew of the condition beforehand. Similarly, a city’s boundaries do not establish ownership or control of every sidewalk, transit area or property within them.

Pasadena’s maintenance page makes another useful distinction: the Street Maintenance division handles bus benches, while bus shelters at some locations are maintained by a private contractor. That is a reason to investigate the exact fixture and arrangement, not a conclusion that any particular contractor owes compensation. [2]

Show what the fall changed

Keep medical records and bills, treatment recommendations and a dated account of symptoms and limitations. Tell your providers and reviewing lawyer about earlier conditions and symptoms so the injury assessment is based on an accurate history. A delayed complaint should be described truthfully, with the dates you remember.

For work losses, preserve missed-shift records, pay information, employer correspondence or records showing work you could not perform. For daily-life limitations, write down the specific task and the effect: for example, help needed with a household activity or an interrupted routine. These records support evaluation; they do not guarantee that every claimed item is recoverable.

There is no reliable settlement amount based only on the type of floor, the business name or the city. Evidence of responsibility and causation, the nature and duration of the injury, documented losses and other case-specific issues need review. An insurer’s request for records or an incident number is not an admission that it accepts liability.

Do not wait for a repair or a records response to check time limits

California Code of Civil Procedure section 335.1 generally provides two years for an injury action caused by another person’s wrongful act or neglect. Different rules, exceptions and accrual questions can change the analysis. Do not use this general statement to calculate your own last filing day. [6]

For a public-entity injury claim, Government Code section 911.2 generally requires presentation within six months after accrual. That is a separate step from filing a lawsuit. Additional lawsuit deadlines can follow the claim process, so a claim acknowledgment is not permission to wait indefinitely. A maintenance request or records request should not be treated as satisfying the claim requirement. [7]

Raise a possible public-property issue early, even if you do not yet know the correct entity or have every medical record. The California injury-deadline guide provides background, not an individualized deadline assessment.

How a case review can clarify the next step

Bring the location log, incident acknowledgment, photographs, correspondence, available medical information and anything you have been asked to sign. Identify what is missing and any pending maintenance, records or claim correspondence. The first discussion can separate what is known from what needs investigation.

Providence Trial Lawyers can review the facts and discuss the evidence and legal issues a claim may involve. Case acceptance and the scope of work depend on evaluation and an agreement. This page does not create an attorney-client relationship. Our Los Angeles slip-and-fall service page explains the broader practice.

Questions about a Pasadena slip or trip and fall

Does reporting a broken sidewalk make a compensation claim?

Do not assume so. Pasadena has separate maintenance and liability-claim routes. Use the correct process for the task and get advice about the entity and claim requirements that apply to your situation. [2] [3]

Is the adjacent property owner automatically responsible?

No automatic conclusion follows from the City’s permanent-repair statement. Maintenance duties and injury liability need separate analysis based on control, the condition, causation and applicable rules. [1] [2]

Can I ask for a review if I do not know who controlled the location?

Yes. Bring an accurate location description and the information available to you. Identifying the relevant parties can be part of evaluating the claim; do not delay deadline advice while trying to solve that question alone.
