What we investigate after a Torrance slip and fall

A fall alone does not establish that a property owner owes compensation. California’s ordinary-care rule addresses injuries caused by a lack of reasonable care in managing property. We investigate the condition that caused your fall, who was responsible for the area and how the injury connects to what went wrong. California Civil Code section 1714 supplies the general rule; the facts and applicable exceptions matter.

The investigation may concern a spill in a store, a loose floor covering, damaged stairs or an uneven walking surface. We look beyond the business name on the door. Ownership, leases, maintenance arrangements and the actual use of the area can help identify whose conduct needs examination.

Questions we want to answer include:

  • What caused you to lose your footing, and where exactly did it happen?
  • Who controlled or maintained that part of the property?
  • Do photographs, video or witnesses show the condition before anyone changed it?
  • What do inspection records, repair requests or earlier complaints show?
  • What treatment and other records document the injuries and disruption that followed?

You do not need to have all of those answers before calling. Our Los Angeles slip-and-fall practice page explains the broader practice; a Torrance consultation starts with your particular location and circumstances.

Preserve evidence after a Torrance slip and fall safely

Get medical attention for your injuries. If you can safely gather information, or someone can help you, preserve a record of the scene before a spill is cleaned or a defect is repaired.

  1. Photograph the condition and the surrounding area. Include a wider view showing the entrance, aisle, stairway or nearby address so the location is identifiable.
  2. Tell the owner or manager what happened and ask for a copy or reference number for the incident report. Keep your own account of whom you spoke with and when.
  3. Save witness names and contact information. Note where cameras were visible without assuming they recorded the fall.
  4. Keep the shoes and clothing you wore, original photographs, receipts and messages. Avoid altering items that may help explain the incident.
  5. Keep medical records, bills, work-absence information and a dated account of activities your injury has affected.

Tell a lawyer promptly if video may exist so preservation can be addressed. We cannot promise a recording is available or recoverable. If an insurer asks for a recorded statement, a broad medical authorization or a signed release, get advice about that request before responding. Keep the request and any stated deadline.

A Torrance repair report is not a damages claim

After a fall on a sidewalk or other public property, reporting the hazard and seeking compensation are different tasks. A maintenance request alerts an agency to a condition. Do not treat that request as a substitute for presenting a formal damages claim to the correct public entity.

What you are doing What the record is for What to keep in mind
Reporting a fall to a store or property manager Recording the incident with the business An incident report does not establish liability or file a lawsuit.
Reporting a sidewalk or street problem through Torrance Public Works Asking for inspection or maintenance A repair request is not the City’s formal damages-claim process.
Presenting a claim for damages to a public entity Seeking compensation through the applicable government claim procedure The correct recipient, required information and deadline need separate attention.

The City’s Street Operations page links to its service-request system and gives separate reporting information for Caltrans-owned streets. Use that resource to report a maintenance issue, not to assume an injury claim has been filed.

For a claim against the City, Torrance’s Claim for Damages instructions say to complete and sign the claim form, then mail it or deliver it in person to the Office of the City Clerk, 3031 Torrance Blvd., Torrance, CA 90503. Follow the current form’s complete instructions and keep a copy and delivery records. The City lists 310-618-2870 for filing questions.

Use the current City filing instructions. Torrance now publishes its Submit a Claim for Damages instructions and form at this address. The current page directs signed claims to the City Clerk by mail or in person and says email or fax is not accepted. Confirm the current instructions before sending a claim; do not use a contact email as a filing route.

Keep two separate records. For a hazard report, keep the exact location, date, photographs and any maintenance-request reference. For a damages claim, keep the signed form, attachments, recipient and delivery records in a separate file. This is a practical organizer, not an official form or confirmation that a claim has been properly presented. For a private store or property, keep any incident-report reference and the manager or insurer correspondence too.

Check jurisdiction before choosing a recipient. The City’s claim page identifies Pacific Coast Highway and Western Avenue within Torrance, and Hawthorne Boulevard north of Pacific Coast Highway, as maintained by Caltrans. That is a reason to investigate responsibility for the precise place and condition involved, not to assume every nearby sidewalk claim belongs to the same agency.

Public-property liability also has its own requirements. Government Code section 835 addresses dangerous conditions of public property, causation, foreseeable risk and specified employee-conduct or notice requirements. A public fall does not automatically make the City responsible. We can review the location and facts before you rely on a particular claim route.

How long do you have to act?

For an ordinary California personal-injury lawsuit against a private party, the general limitations period is two years under Code of Civil Procedure section 335.1. The date the period begins and any exceptions require an individual review. Do not assume every fall gives you two years to complete every required step.

For a California state or local public-entity personal-injury claim subject to the government claim process, Government Code section 911.2 generally requires presentation no later than six months after the cause of action accrues. That is a claim-presentation deadline, not the deadline to file the later lawsuit.

Subject to statutory exceptions, Government Code section 945.4 requires the claim to be presented and acted on, or deemed rejected, before a covered damages lawsuit can proceed. Separate lawsuit deadlines follow. Get advice promptly about your exact dates, including any rejection notice. If time has already passed, ask about your options rather than assuming either that the claim is safe or that nothing can be done.

Documenting what the injury has cost you

A claim should reflect the harm the evidence supports. That means examining treatment expenses, missed work and the effect of the injury on daily life. If ongoing care or future work limitations are an issue, those needs require support rather than an estimate based only on the type of fall.

California’s general tort-damages rule concerns compensation for harm proximately caused by the wrongful conduct. See Civil Code section 3333. What is recoverable in your case depends on liability, causation, proof and applicable law. There is no reliable settlement number we can give you simply because your accident was a slip and fall.

Bring the records you have. We can discuss what else may be needed without asking you to put a price on your injury during the first call.

Working with Providence Trial Lawyers

Providence Trial Lawyers, formerly Law Offices of Edward Y. Lee, has helped injured clients since 1995. Our $375M+ recovered is a firmwide figure across matters, not a Torrance slip-and-fall result or a prediction for your case. Learn more about our firm and approach.

We begin by listening to your account and the problems the injury has created. If we represent you, we handle the evidence work and insurance pressure while keeping communication direct. We prepare cases with trial in mind rather than relying on a quick settlement offer to resolve unanswered questions about responsibility or injury.

When an offer comes, we explain it and advise you. We do not settle without your approval.

Questions about hiring a Torrance slip-and-fall lawyer

Can I contact you if I did not take photographs?

Yes. Tell us what you remember and what records you do have. Witnesses, incident reports or other records may help the investigation, although none is guaranteed to exist or prove the claim. Do not return to an unsafe location just to collect evidence.

The store says it did nothing wrong. Does that end the matter?

The store’s position is something to investigate, not a substitute for reviewing the evidence. We can examine what caused the fall and what information is available about the condition and the people responsible for the area. We will also explain evidence gaps that may affect whether a claim can proceed.

I reported the sidewalk problem. Have I preserved my claim?

Do not assume so. A maintenance report and a formal government damages claim serve different purposes. Have a lawyer review what you submitted, when and to whom. Use the City’s linked claim instructions for the formal City process, and confirm whether the City is the correct entity before relying on it.

Do you have an office in Torrance?

No. We serve clients injured in Torrance from our Los Angeles office at 777 S. Figueroa St, Suite 3050, Los Angeles, CA 90017. Call to discuss your fall and how to begin a consultation.

What does a consultation cost?

The consultation is free and available 24/7. No fee unless we win. You can use the conversation to explain what happened, ask about evidence and deadlines, and decide whether to take the next step with Providence.

Tell us where the fall happened

Start with the date, the precise location and how the injury is affecting you. If you have an incident report, insurer letter or government response, have it nearby for the conversation.
